Default Rental question

When i moved in to my apt over 2 years ago, i have gave a security deposit and also a non refundable pet deposit, plus a monthly pet rent fee of $25.

I have been told that when i move out, Maintenance will pull my carpets and if there are any stains through the carpet backing they will charge me for full carpet. Well i pulled the carpet myself and saw some stains.

Is that legal? What the heck did i pay all this money for?

Basically you gave them the money to ensure that they have it if you move out and the apartment is anything less than 100% perfect. Basically you really have no recourse against them if they want to take it, and from the sound of it they are going to take your money

I think all those deposits should go toward the carpet replacement and anything else they might need to do.

If the place is perfect, then you should get your money back.

Actually let me clarify, just read my lease agreement.

I have a refundable deposit of $250 to move in and a $150 refundable pet deposit

A non refundable deposit of $200 for cleaning when i move out and another $300 non refundable pet deposit plus $20 bucks a month

They said they will charge me an additional $800 for carpet replacement which will be taken out of my refundable deposit and i will still owe them $400.

I would think deposits are supposed to cover that sort of thing. If they expect to replace the carpet of the units pet owners rent, then it seems to me the pet deposit should be equivalent to the cost of the carpet.

If the lease didn't specifically state that you will be responsible for the cost of carpet replacement when you leave, I'd tell them to stuff it.

I read the agreement and it doesn't say anything about replacing carpets. I just said to clean.

If they send me to collections, i'm assuming i can fight that in small claims court? and at the BBB?

Check and see if there is a tenants rights group in Nevada and if there is, contact them and find out what your rights really are. I can't imagine with all of the money they are making off of you every month for having a dog that they would want more, because of stains that are under the carpet. Hell, you don't even know if the stains were there before you because you didn't pull the carpet when you moved in. That kinda sounds like BS to me. They could charge every tenant for the same stains if they aren't visible on move-in.

I guess I don't understand.

How can a deposit be "non-refundable"........The word deposit means it's money on hold.

Either they need to use that money to clean your apt, or they don't.

If they don't, they need to return it to you.

So they are saying just the fact of owning a pet is going to result in $300 non-refundable cleaning costs, no matter if there aren't any stains at all?

So they get 500 bucks for nothing when you move out and you paid 240/yr for this pet? What did they collect an extra 550 for if they didn't expect anything more to be damaged (carpet) because of the pet? I never get these pet charges because they just charge you again for the shit the pet caused anyways.

For all you know they stained the padding before the carpet was put down. Nice way to guarantee extra money when a tenant moves out.
