Two points here.

First, it seems odd that the man was found guilty and sentenced when the prosecution in the case offered only one witness, whose testimony was not heard because it did not relate to the case in question, but the defense had plenty of testimony on his behalf.

Second, how is it that Tom Delay is being locked up, but Charlie Rangel is not only free, but still a sitting congressman?

There was only one prosecution witness offered at sentencing. The trial was different.

Charlie Rangel is free because he played the "Whoops, my bad. I'll just pay those back taxes now." card. Delay chose to fight his charges instead.

I see. I misunderstood that this was strictly a sentencing hearing.

Carlie Rangel didn't just violate tax law. He was recently censured for all sorts of inappropriate use of funds via his PAC, including using PAC funds to mount his legal defense for the hearings about inappropriate use of funds.
