If the suspension stands, then he'll win. I have no idea if the $1M would be considered a reasonable penalty but, given how juries tend to act in such cases, odds are that he'd get what he's asking.
.... though I've always considered his, "I wasn't with them." comment to be bullshit.

Thing is that suspensions like that are frequently political expedients, rather than supportable actions.
