Correct because..... you have to enter a car to be in it. There isn't an "in it" state for a motorcycle. Now I'm not defending this idiot if this story is true but on the other hand, what if it's not entirely true? What if, and I DON'T condone this, BUT what if he just sat on the dude's bike to check it out? I admit, I'd kick his ass, but is that a "crime" punishable by the law?

Same goes for cars. If someone is in the car without tampering with it or attempting to move it, not illegal. We know of a few Miata owners that have warned us to park it with the top up, their experiences with people getting into the car brought on their advice.

thing that gets me is that if he had started it and tried to ride away, it will end in one of two ways. 1. He evades his pursuers. 2. He wrecks the bike. There is no third option. This guy just stole a bike, do you really think he's just going to pull over? Not a chance.
