Because the child is directly responsible.
The parents are being sued because they are partially responsible.

The women had osteoporosis otherwise her hip wouldn't have fractured...and everyone knows that 80 plus year olds that go in for hip surgery usually die on the table or shortly thereafter.

This was a mercy killing by God. lol

Are you saying that the time when you die should be determined by someone else?

Sue the mother and you have to sue the child too, I would say, as the principal in the incident. Sounds to me like someone was being negligent and it's the mother, but the child likely has to be party to the suit in order for it to go forward. The costs incurred as a result of this incident were likely pretty heavy. Why should the estate be on the hook, for something that someone else caused?

There are slight updates to the story

NEW YORK

Quote:
An article in some editions on Friday about a lawsuit that claims an elderly woman was severely injured by two 4-year-olds racing their bicycles on a Manhattan sidewalk misstated the timing of the woman’s death. The woman, Claire Menagh, died of unrelated causes three months after she was struck, not three weeks. (Go to Article)

This case is really about street racing.
In Canada they would confiscate the bikes.
