alcohol and concealed carry permits
i'm trying to figure out what the laws are concerning being drunk and in possession of a firearm. i know it's a retarded idea but me and my roommate are having an argument about it. if anyone can help i'd appreciate it

If you are in your home and on your property I'm guessing you can get as drunk as you want with as many guns as you want and that's without a concealed or carrying license.
But I'm assuming you are talking about in public locations where a CCW would apply. Here in Georgia I could carry a firearm into a bar (open or concealed) but the bar can deny you too (which is their right). But if I even have 1 alcoholic beverage I'd be in trouble. What kind of trouble, I have no clue.

In Mississippi you cannot conceal a firearm in a location that makes over 50% of their revenue selling alcohol by the drink. So I can carry in Chili's, but not the Fort Bayou Saloon. There's no specific law about being drunk with a firearm, but it would affect your sentence if you had to go to court. On your own property anything goes, but again, if you're drunk with a firearm and something happens you're getting fried in court.

my main question is, what if you get stopped for drunk in public and you have a gun on you but you also have a concealed carry.

Either way I say Fuck Em'. 2nd ammendment says I can bear that bitch if I want to. Though private property rights supercede my right to carry on someone's property. Though I wonder if an argument could be made that since the state allows it, a private business can't deny someone the ability to carry a pistol into their place of business (I wouldn't agree but wondering).

Yep don't carry if you plan to drink. Plain and Simple..
Virginia also just recently changed the law to where you could carry and go into a place that serves alcohol. I personally tend to avoid most eating establishments or store with "NO CONCEALED WEAPONS Guns or knives" signs on their doors. If its concealed how would you ever know if I have it. (I mostly avoid all places with these signs) Here is a link for a list of those in Virginia http://www.vcdl.org/static/gue.html I guess I can't carry my Kershaw pocket knife in a restaurant cause I might want to pull it out and hurt someone, yet you serve me a steak with an 8" serrated steak knife. |
