I have no idea, and in this situation she didn't commit statutory rape anyway. A line has to be drawn and it does create a situation where one day someone is a kid and having sex with them will get an adult sent to jail while the next day it is legal. What remains is this teacher knew exactly what the consequences were and risked it anyway.
