Ohio inmate's too-fat-to-execute argument fails Story Highlights
Richard Cooey, 41, scheduled for execution Tuesday

Ohio's Supreme Court rejects argument he's too obese for injection

Attorneys argued prison food, limited exercise made him fat

Cooey's execution could be first in state since moratorium

The Ohio Supreme Court has rejected arguments that a death row inmate is too fat to die by lethal injection.

Richard Cooey, 41, is scheduled to be executed on Tuesday.

Justices on Thursday gave the go-ahead to execute Richard Cooey.

The 41-year-old is scheduled to be executed Tuesday for killing two University of Akron students in 1986.

He would be the first person to be put to death in the state since the end of a de facto moratorium on lethal injection.

Cooey's attorneys had argued that prison food and limited opportunities to exercise contributed to a weight problem that would make it difficult for the execution team to find a viable vein for lethal injection.

Cooey is 5 feet, 7 inches tall and weighs 267 pounds.

why they let that fat waste of fooking oxygen live for 22 years after he was convicted is beyond me....

i'da happily saved the states hundreds of thousands of tax dollars by executing him with an axe handle and a pen full of starving hogs

My next crusade is to find the guy in Detroit that just got off for cooking his kid on the family BBQ grill.

I wanna know WTF their holdup is on executing death row inmates? given the job, I'd gladly be there at the courthouse, as soon as they're sentenced to death, take em behind the court house to a big brick wall and hand me the 9mm. this shit about sitting on death row for like 20 years is retarded, soon as they're sentenced, just go polish up old sparky and throw their ass in the chair.

Exactly. Until you have fool proof evidence (typically dna) there is always a chance that the person is innocent. No sense in killing an innocent guy and letting the real killer walk. Unfortunately there really is no way to prove that anyone is 100% guilty.

Hell yeah. I say just cut his throat, all youd have to do is lift a couple spare chins and slice away.

I think there should be a universal killing procedure for all living things. If livestock can be killed with a hammer or extension cord then so should killers, rapest and who ever touches my bike without permission.

An appeal, as in one, should be automatic and required in death penalty cases, but it shouldn't last 20-25 years.

And don't worry about the chance of killing someone innocent. None of us are and God has no problem sorting us out!
