When I was about 50' in front of her ( I had slowed to 20 mph from the 35 I was doing ) , she turned directly infront of me. I locked up the brakes but she hit the front of my car, rolled up the hood and back off the front.

A neighbor heard the crash and called the ambulance. She had a broken jaw , broken arm and some cuts. Her parents came down from NYC to the local hospital she was at and were so thankful I stayed with her and made sure she got the care she needed.

Those kind parents waited until I turned 18 and then sued me for $150,000 ( a hell of a lot money in 1978 )

I lost the suit because I did NOT have full control of my motor vehicle.

It won't matter if the cyclist in the original story was doing 15 under the speed limit, he's screwed.

What's even better is the parents probably tell her every day that she did no wrong and your a spawn of satan and should burn in hell.

I also had an extensive computer aided reconstruction of the accident which was to be presented at trial, performed and presented by a former Policeman of Middletown NJ, which completely absolved me.

The policeman at the scene told the Asbury Park Press newspaper that the boy would receive two citations for crossing against the light, and where there was no crosswalk. I have a copy of the paper. He stood on my front porch, and with a straight face said this to my 11 year old daughter and myself.

The officer later changed his story in court, as it turns out the boy was never issued any summonses, and the whole thing was then instead rammed up my ass.

It was on a divided highway (Route 35) and the boy struck THE SIDE of the front of my car. He ran ME over, in other words. The is NO damage to the front of my car. The side marker just ahead of the left front wheel clearly shows where he ran up on ME.

I was in the far left lane, against the jersey barrier. The boy ran onto the road from the left. I had NOWHERE TO GO to prevent him from literally running onto my hood.

It doesn't matter what the truth is, or who's really at fault.

They do what they please with you, and unless you can find the sympathy of someone in the press to defend you, you're fucked.

And oh, one more thing. No one comes to the defense of someone who hits a child. Even when it's not at all your fault, and he actually "hit" you.
I was still right... You need to have 100% control of your vehicle (in most states). And in this case it looked like you did. The kid hit you, not the other way around. In CA, however, peds have to follow the rules of the road. If you run out in front of traffic on the freeway you are roadkill to the CHP and are at fault.

Oh course cops are gonna lie and twist shit up because they and the DA have each other in their pockets. That and the fact they are cops and lawyers. LOL

If I ran out in traffic, didn't look or whatever when I was younger, my ass got beat. My parents didn't yell at the car (unless they were speeding or weaving), but it was my fault for not looking. Parents today for the most part are a joke when it comes to responsibility.

And while the above is correct, you're still wrong for the reason I stated:

It doesn't fucking matter who's at fault. If a child is involved, and ESPECIALLY if you are driving a sports car, or motorcycle, YOU ARE SIMPLY MADE OUT TO BE AT FAULT, BY THOSE IN POWER.

That was MY POINT.

Case in point: One of the two big "racing" incidents that led to our recent racing and stunting incidents involved two young guys in ricers, who hit the car of a couple who were out celebrating their anniversary while their young daughter was at home with a sitter.

The papers were full of how these evil racers had been doing almost 100 Kmh (60 MPH) over the limit, while racing on city streets, and had robbed this little girl of her parents. Police played it up every time that they were interviewed. Politicians remarked on it while proposing the law.

Several things came out in court, that were rather interesting. The two "racers" weren't racing, and were doing perhaps 30 Kmh over the limit, which in that area was IIRC 70 Kmh. In addition the couple who were killed while innocently celebrating their anniversary had been drinking. In fact the husband, who was driving, was significantly over the legal limit for alcohol.

Very few people seem to know those facts, but everyone who watches the news or reads a newspaper remembers how evil street racers left a poor little girl an orphan.

Me, being a guy with insurance, was just a cash cow for them. The kid probably never got a dime of the money.

Our "justice" system awards people for stupidity. Why bother playing the lottery when you can become wealthy by suing someone?

Just curious, why would the cop care, and what's in it for him to lie?

Who is going to give him money to lie? The kid's parents or lawyers? I could see that maybe. But as for the DA having the cop in his pocket, I don't see that.

Cops are predisposed to hate anyone that's having more fun than they are.

You get a boner, they wanna whack it.
